REVIEWING THE HOLIDAYS ACT
The Restaurant Association is actively
supporting a call for a review of the Holidays Act.
The majority of our industry works on a
rostered basis, rarely works on the same
days every week and rosters generally
The Act is reasonably straight forward if
your employees work Monday to Friday on
a standard eight hour day. If not it can be a
minefield of quite complicated and frustrating
formulas. If you are open on a public holiday
that happens to fall on the weekend, well there
is no end to the pain...first you must work out
whether or not it is a regular day of work for
them. If it is not clear whether a day would
otherwise be a working day for the employee,
the employer and employee must try to reach
an agreement on the matter.
In doing so you will have to consider the
1. the employee’s employment agreement;
2. the employee’s work patterns;
3. any other relevant factors, including –
• whether the employee works for the
employer only when work is available;
• the employer’s rosters or other similar
• the reasonable expectations of the
employer and the employee that the
employee would work on the day
4. Whether but for the day being a public
holiday, would the employee have worked on
the day concerned.
If an agreement cannot be reached, a Labour
Inspector may make a determination.
This is quite a list to consider (and only one
portion of the Act) when you have more than
one employee. This isn’t even considering
the process you would need to go through to
calculate what they should be paid...this is so
complex even government departments get
At the Association, we recently reviewed our
top twenty FAQ’s from members and five
of these related to the Holidays Act. In my
time dealing with the interpretation of many
different pieces of legislation spanning over the
last ten plus years, the Holidays Act is one of
the most cumbersome.
